Upcoming PFAS Disclosures Requirements Under the Federal TRI & TSCA Programs


Per- and polyfluoroalkyl substances (PFAS) are found in a vast range of industries and products - from chemical plants to data centers, from consumer health products to firefighting foams. PFAS represent complex and cross-functional risks to companies, spanning their entire operation, driven by: ubiquity in the supply chain; emerging and disparate regulations; and, public and political pressure, including environmental justice concerns.  

Join us for a presentation and discussion about the basics of PFAS and the upcoming PFAS reporting requirements under the US EPA’s Toxic Release Inventory (TRI) Program and the Toxic Substances Control Act (TSCA). Topics will include the reporting requirements and timeline, and best practices we have gathered through our work supporting businesses navigate these complex regulatory requirements. 

 Lori Dinkelman

Lori Dinkelmann is a national Subject Matter Expert (SME) on the Emergency Planning and Community Right to Know Act (EPCRA), Toxic Release Inventory (TRI) Reporting Program. Ms. Dinkelmann has over 29 years of experience with EPCRA TRI Program consulting and leads ERM’s national TRI Reporting Team. Ms. Dinkelmann’s extensive TRI Program expertise includes performing multifaceted TRI applicability evaluations for individual facilities and national portfolios, preparing complex TRI threshold/release calculations and disclosure reports for a multitude of business sectors and complexity of operations, developing and implementing TRI compliance programs at the facility and portfolio levels, optimizing facility cross functional data management practices to support TRI and other environmental disclosure reporting, auditing client TRI Programs for compliance, and backfiling and resolving EPCRA violations under the United States Environmental Protection Agency’s (US EPA) Audit Policies. She also provides in-depth TRI Program training based on her years of experience with a multitude of scenarios and unique applicability situations.
 
Following inclusion of certain PFAS in the TRI Program under the US 2020 National Defense Authorization Act (NDAA), Ms. Dinkelmann has consulted extensively on the potential business/regulatory risks and implications associated with TRI reporting and disclosure of facility PFAS chemical releases. Ms. Dinkelmann and her team have supported multiple clients in performance of PFAS due diligence programs to identify regulated PFAS chemicals within company/facility supply chains, both to facilitate TRI reporting applicability assessments for regulated PFAS and to determine material business risks and implications based on identified PFAS footprints within the value chain.


PFAS from a Downstream Perspective


PFAS is present in a wide variety of materials that make it into the waste stream. This presentation will review PFAS from the perspective of the downstream receiver of PFAS containing waste materials, covering issues related to wastewater pre-treatment, thermal processing, management of regulatory uncertainty and change and the impact on the waste management system.

Mike Van Brunt - ReWorld

 

Michael Van Brunt is currently VP Environmental and Sustainability at Reworld, where he is responsible for corporate sustainability strategy and reporting and environmental compliance, permitting, and monitoring. He leads Reworld’s lifecycle analysis team and is a licensed professional engineer with over twenty years of experience in industry and consulting. He is current the board chair of the Circular Economy Coalition. He earned a B.S. and Masters in Agricultural and Biological Engineering from Cornell University.
