What happened:
The City of South Padre Island filed a notice to its website on June 24 in applying to the Texas Secretary of State for a place on the 2023 ballot for the Nov. 7 general election.
Why it matters:
According to the Secretary of State’s website and City Secretary Angelique Soto:
“Cities, Schools, and Other Political Subdivisions: Post Notice of Deadline to File Applications for Place on the Ballot (PDF) in a building in which the authority maintains an office. The notice must be posted not later than the 30th day before the first day to file. (Sec. 141.040; Sec. 49.113, Water Code). This notice must be posted in addition to the posting the requirements and deadline for filing for candidacy under Section 2051.201, Government Code.”
The City posted The Notice of Deadline on June 23. The document states the first day to file was July 24. Thirty days before the first day to file is June 8 (business days). The City posted its first election notice on June 30 in the Island Vibes Newsletter.
What now:
The Texas Election Code states that a notice of an election must be given by publishing the notice at least once, not earlier than the 30th day or later than the 10th day before
Election Day. Publication must be done via a newspaper, or posting in a public place in each election precinct no later than the 21st day before Election Day, or by mailing no later than the 10th day before election day.
