According to a Reuters article by Daniel Wiessner, The U.S. National Labor Relations Board (NLRB) announced it will pause its case against SpaceX, which accuses the company of illegally firing engineers critical of CEO Elon Musk, while SpaceX pursues a lawsuit challenging the agency's structure. Despite disagreeing with SpaceX's claim that halting the case is appropriate, the NLRB agreed to the suspension to conserve judicial resources and avoid unnecessary expenses.
The case has moved between U.S. District Judge Rolando Olvera and the 5th U.S. Circuit Court of Appeals over procedural issues. The NLRB stated in a filing that suspending the case will expedite a final ruling on SpaceX's constitutional claims against the agency's enforcement proceedings.
Judge Olvera rejected SpaceX's request to reconsider transferring the lawsuit to California, allowing the company 21 days to file another appeal. SpaceX denies the firings were unlawful and argues that the NLRB's administrative process violates its constitutional rights.
The NLRB will suspend the administrative case once Olvera issues an order on the motion to block it, enabling the 5th Circuit to return the lawsuit to him. SpaceX has also filed a second lawsuit in Waco, Texas, challenging a separate NLRB complaint about severance agreements, which a judge has temporarily blocked.
